California Appeals Court Sets Date for Argument in Long-Pending Adequacy Cases

Three and a half years after the briefs were filed, the California Court of Appeals for the First Appellate District has finally set January 27, 2016 as the date for oral argument in  two related adequacy cases, Coalition for Quality Education v. California and Robles-Wong v. California. Plaintiffs in these cases are arguing that even with recent increases in state aid, the State’s funding scheme is entirely divorced from educational realities and actual costs, and the State’s continued reliance upon it constitutes a violation of the state constitution. They contend that the district court erred in holding that the California constitution lacks a qualitative, enforceable right to an education, even though the state Supreme Court long ago held in Serrano v. Priest that education is a “fundamental interest” under the state constitution.
